Smith, Esq., OSB #120112, have elected to sell the said real property to satisfy the obligations secured by said Trust Deed and notice has been recorded pursuant to Section 86.735(3) of Oregon Revised Statutes. The default for which the foreclosure is made is the Grantor’s failure to pay: Failed to pay the principal balance which became all due and payable based upon the failure to pay taxes and/or insurance, pursuant to paragraph 7(C)(III) under the Note, and pursuant to paragraph 10(C)(III) of the Deed of Trust. By this reason of said default the Beneficiary has declared all obligations secured by said Trust Deed immediately due and payable, said sums being the following, to-wit: The sum of $104,765.48 together with interest thereon from June 16, 2021 until paid; and all Trustee’s fees, foreclosure costs and any sums advanced by the Beneficiary pursuant to the terms of said Trust Deed. Notice is further given that any person named in Section 86.753 of Oregon Revised Statutes has the right to have the foreclosure proceeding dismissed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due (other than such portion of said principal as would not then be due had no default occurred), together with the costs, Trustee’s or attorney’s fees and curing any other default complained of in the Notice of Default by tendering the performance required under the obligation or Trust Deed, at any time prior to five days before the date last set for sale. Without limiting the Trustee’s disclaimer of representations or warranties, Oregon law requires the Trustee to state in this notice that some residential property sold at a Trustee’s sale may have been used in manufacturing methamphetamines, the chemical components of which are known to be toxic. Prospective purchasers of residential property should be aware of this potential danger before deciding to place a bid for this property at the Trustee’s sale. INVITATION TO BID (ITB)

RUNWAY 16-34, MIRL, SIGNAGE, 

AND NAVAID IMPROVEMENTS PROJECT

HOBBY FIELD Airport

Creswell, Oregon

A.I.P. No. 3-41-0083-016-2021 and 3-41-0083-017-2022

Sealed proposals will be received by Shelley Humble, Airport Manager of the City of Creswell at the City Administration building, Reception Desk, 13 South 1st St, Creswell, Oregon 87426 until 2:00 p.m. local time on the day of February 9, 2022, at which time bids will be publicly opened and read. Sealed proposals may also be sent by mail, but must be received by the date and time above after which the City of Creswell shall not accept bid offers. Bids received after the stipulated time shall be returned unopened.

The work contemplated consists of, but is not limited to, the following:

  1. Runway 16-34 pavement reconstruction (3,102’ x 60’) and two connector taxiways

  2. Pavement Edge Drains 

  3. NAVAIDs – REILs and PAPIs

  4. Medium Intensity Runway Lights (MIRL)

  5. Guidance Signs

Qualification –

• See Section 20-02 Qualification of bidders for full contract requirements.

  o Contractor may demonstrate qualification of work to be prequalified by ODOT for the following classes of work;

   ■ AB, AC, ACP, EART, LS, MHA, PAVE

Contract bid documents will be available on Wednesday, January 12, 2022. Copies of the contract bid documents along with the plan holders list may be obtained through ARC Document Solutions at the bidder’s own expense. The project is for a public works improvement and is subject to both state prevailing wage rates under ORS 279C.800 to 279C.870, and the federal prevailing wage rates under the Davis-Bacon Act (40 U.S.C. 3141 et seq.). The Contractor agrees to be bound by and will comply with the provisions of 279C.838, 279C.840 or 40 U.S.C. 3141 to 3148.

The proposed contract is funded in part by the Federal Aviation Administration and therefore is subject to the following federal regulations:

  1) Buy American Preference

  2) Foreign Trade Restriction

  3) Davis Bacon

  4) Affirmative Action

  5) Government-wide Debarment and Suspension

  6) Government-wide Requirements for Drug-free Workplace

Additional federal regulations apply and are contained in the contract document. 

Each proposal must be submitted on the prescribed form and accompanied by a certified check or Bid Bond on the form bound within the Contract Documents or one similar, payable to City of Creswell in an amount of five percent (5%) of the amount bid. 

Each prospective Bidder is encouraged to attend a mandatory pre-bid conference to be held at 10:00 am local time on Friday, January 28, 2022 at the City of Creswell – City Hall, 13 South 1st Street, Creswell, OR. At this meeting, questions concerning the Contract Documents or proposed work will be discussed. Answers and clarifications will be in the form of written addenda to the contract and will be distributed to all prospective Bidders. The pre-bid conference will be the only opportunity for contractors to view the project limits of work within the airport. No additional site visits shall be conducted by the Owner. Mask covering nose and mouth due to COVID protocol are mandatory. Face shields are not approved as an acceptable mask.

The Owner reserves the right to waive any informality or may reject any or all proposals not in compliance with all prescribed public bidding procedures and requirements, or not conforming to the intent and purpose of the contract documents; including the requirement to demonstrate the bidder’s responsibility under ORS 279C.375 (3)(b), and for good cause, all bids may be rejected if it is in the public’s interest to do so. No Bidder may withdraw his or her proposal within 60 Calendar days after the actual date of the opening thereof.

The Owner will not receive or consider an Offer for a Public Improvement Contract unless the Offeror is registered with the Construction Contractors Board, or is licensed by the State Landscape Contractors Board, as specified in OAR 137-049-0230;

If specified in the elements of work, or as a result of changed conditions, the Contractor or a subcontractor under the Contract must be licensed under ORS 468A.720 regarding asbestos abatement project work.

The City of Creswell in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.

The award of the contract is subject to approval of the Federal Aviation Administration and availability of federal funding.
